Bidders agree that the decision to bid and the amount they bid have been based solely on his or her own independent inspection and evaluation of the auction assets. MIDWEST LAND AND HOME LLC (“MIDWEST”) AND SELLER FURNISH ALL AUCTION ASSETS TO SUCCESFUL BIDDERS “AS IS,” UNSUPPORTED, WITHOUT WARRANTY OF ANY KIND. MIDWEST AND SELLER DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  Assets are sold in their actual current condition, with all faults and defects, and with all errors of description. Midwest’s liability to a purchaser will never exceed the purchase price actually paid for an asset.
Successful bidder must contact Midwest within 24 hours of the winning bid. Payment is due via cash or check but will require 7 business days for check to clear before pick-up of the item in issue. NO EXCEPTIONS.  ALL PAYMENTS MUST BE RECEIVED WITHIN 5 DAYS OF THE AUCTION DATE. Over payments will be charged a 10% Refund Fee with a minimum of $35. If a successful bidder fails to pay for any item within the 5-day time period, such bidder will be declared in default and Midwest will have the right, in its sole discretion, to immediately resell the item in issue.
Buyers are responsible for the cost of the purchased items mobilization, disassembly, rigging, transport, insurance and all other costs related to physical transfer of the auction items purchased from the designated location at the time auction bidding ends. All items and equipment must be picked up on or before May 2, 2022 unless other arrangements are made in writing.
Midwest may declare an asset abandoned when the buyer fails to remove an asset from the designated site by the stated removal deadline. When Midwest declares an asset abandoned, Midwest may, in its sole discretion, resell the abandoned item in an upcoming auction on the buyer’s behalf for an additional administrative fee of 20 % of the original invoice price (minimum $1,000 fee), reasonable storage fees, and account for the resale. If the proceeds from the resale are insufficient to cover the administrative and storage fees accrued, buyer will owe such deficiency and Midwest will retain all legal remedies relating to such amounts against buyer. Any net proceeds will be released to buyer, calculated as the resale bid price collected, less foregoing administrative and storage fees accrued.
In any matters in which Midwest and/or any of its officers, managers, members, employees, agents and/or assigns is made a party, the laws of the State of Kansas shall apply, without regard to its law pertaining to conflict of laws, and any dispute shall be decided in the state courts of Marshall County, Kansas. All claimants placing online bids for assets offered by Midwest consent to the personal jurisdiction and venue in such Kansas state courts.
